OFFICIAL SWEEPSTAKES RULES
1. NO PURCHASE NECESSARY TO ENTER OR TO WIN. A PURCHASE WILL NOT INCREASE YOUR ODDS OF WINNING. ALL FEDERAL, STATE, LOCAL AND MUNICIPAL LAWS AND REGULATIONS APPLY. VOID WHERE PROHIBITED.
2. Eligibility. Subject to the additional restrictions below, the Canongate Golf Clubs Golf Georgia Membership Sweepstakes (the “Sweepstakes”) is open to residents of Georgia who possess a valid driver’s license and are 18 or older at the time of entry. Employees of Canongate Golf Clubs (Sponsor), collectively (“Sweepstakes Entities”), or any of their respective affiliates or advertising and promotional agencies, and the immediate family members of, and any persons domiciled with, any such employees, are not eligible to enter or win. The term “immediate family members” includes spouses, parents, grandparents, siblings, children and grandchildren.
3. How To Enter. The Sweepstakes will begin at 12:00 am (E.S.T.) on February 1, 2010 and end at 11:59 p.m. (E.S.T.) on February 28, 2010 (the “Sweepstakes Period”).
On-Line Entry: Enter at www.golfforegeoriga.com and fill out the official registration page, completing all required information and following all instructions. A maximum of one (1) entry per household will be allowed. Multiple entries and entries entered by means of software-generated or other automated processes will be disregarded.
Sponsor will not be responsible for incomplete or late entries or for failure to receive entries due to transmission failures or technical failures of any kind, including, without limitation, malfunctioning of any network, hardware or software, whether originating with sender or Sponsor. All entries become property of Sponsor and none will be returned. In the event of a dispute, all online entries will be deemed to have been submitted by the owner of the email account from which they were sent. For these purposes, an email account holder shall mean the natural person assigned to such email account by the Internet access provider, online service provider or other organization responsible for assigning email addresses for the domain associated with such email account. Any questions regarding the number of entries submitted or the owner of an email account shall be determined by Sponsor in its sole discretion, and Sponsor reserves the right to disqualify any entries by persons determined to be tampering with or abusing any aspect of the Sweepstakes. In the event of a dispute, all internet entries will be deemed to have been submitted by the owner of the email account from which they were sent. Any questions regarding the number of entries submitted will be determined by Sponsor in its sole discretion. Sponsor reserves the right to disqualify any entries by persons determined to be tampering with or abusing any aspect of the Sweepstakes.
4. Winner Selection. One (1) Winner will be selected in a random drawing from among all eligible entries received by each Entry Deadline All decisions of Sponsor in all matters relating to the Sweepstakes are final and binding. The odds of winning the prize will be determined by the number of eligible entries received for each Sweepstakes Period. All winners are considered potential winners until all necessary documents and releases are signed. The potential winners will be notified by phone and/or email and must meet all eligibility requirements including the execution and return of all necessary releases and affidavits. If the potential winner does not respond to notification attempts to contact him/her within twenty-four hours after notification is sent, an alternate winner may be selected at Sponsor’s sole discretion. Notification is deemed sent when an email is sent by Sponsor or a telephone message is left by Sponsor, whichever occurs first.
- Prizes and Odds. There will be one (1) Winner. Winner will receive a complimentary one-year Associate Golf membership to an Atlanta-area club owned by Canongate Golf. The membership includes entry fee, one-year complimentary associate dues, and a one-year range membership. Associated green and cart fees, monthly food and beverage minimums and other items are not included in this prize and the winner will be responsible for paying those items. After the 12-month period, monthly membership dues will apply. Should the winner wish to maintain his membership, he will be responsible for the monthly dues and any other charges made to the account. Prize has an approximate market value (“AMV”) of six thousand dollars ($6000.00). There will be no cash option for this prize and prize cannot be applied to an existing membership. Odds of winning depend on the number of eligible entries received.
- Winner Notification and Acceptance. Winners will be notified within forty-eight hours of the close of the entry period. Sponsor will call only twice during regular business hours at number provided on entry form and will leave no messages. Only one e-mail notification will be sent. Failure to reach winner during these calls and/or e-mail may result in disqualification of winner, forfeiture of his or her interest in all prizes, and selection of a substitute winner from among all remaining eligible entries. Return of e-mail prize notification as undeliverable may result in disqualification and an alternate winner may be selected. Winners may waive their right to receive prizes. Prizes are nonassignable and nontransferable. No substitutions allowed by winner. Prizes and individual components of prize packages are subject to availability, and Sponsor reserves the right to substitute prizes of equal or greater value. Winners are solely responsible for reporting and payment of any taxes on prizes. Winners may be required to complete an affidavit of eligibility, and a liability and publicity release (except where prohibited by law). Failure to sign and return the affidavit or release, or to comply with any term or condition of these Official Rules, may result in a winner’s disqualification, the forfeiture of his or her interest in the prize, and the award of the prize to a substitute winner. Except where prohibited, acceptance of any prize constitutes winner’s consent to the publication of his or her name, biographical information and likeness in any media for any commercial or promotional purpose, without limitation the Internet, or further compensation. Prizes not won and claimed by eligible winners in accordance with these Official Rules will not be awarded and will remain the property of Sponsor. 7. Participation. By participating, entrants agree to be bound by these Official Rules and the decisions of the Sponsor and the Sweepstakes judges. Sponsor reserves the right to disqualify persons found tampering with or otherwise abusing any aspect of this Sweepstakes as solely determined by Sponsor. In the event the Sweepstakes is compromised by a virus, non-authorized human intervention, tampering or other causes beyond the reasonable control of Sponsor which corrupts or impairs the administration, security, fairness or proper operation of the Sweepstakes, Sponsor reserves the right in its sole discretion to suspend, modify or terminate the Sweepstakes in total or any one or more individual Sweepstakes Period. Should all or an individual Sweepstakes Period of the Sweepstakes be terminated prior to the stated expiration date(s), Sponsor reserves the right to award prize(s) based on the entries received before the termination date(s). By entering the Sweepstakes, each Winner agrees to waive any and all claims against the Sponsor and their respective agents and representatives for any injury, damage or loss that may occur from the participation in the Sweepstakes or from the receipt or use of any prize or travel related to the receipt or use of any prize.
8. General Rules and Regulations: By entering the Sweepstakes, participants grant the Sweepstakes Entities and their designees the right, unless prohibited by law, to use their names, voices, pictures and likenesses, without compensation, for the purpose of advertising and publicizing the goods and services of the Sweepstakes Entities and all matters related to the Sweepstakes, including but not limited to all administrative obligations, in any manner or medium, throughout the world in perpetuity. Grand Prize Winner may be required to sign affidavits of eligibility, tax acknowledgement forms, liability releases and, except where prohibited by law, use of name and likeness releases (“Winner Documents”) and return within ten (10) days of issuance. Noncompliance within this time period may result in disqualification. Return of the prize or prize notification as undeliverable, failure of Sponsor(s) to contact winner based on contact information provided at registration, or failure of potential winner to respond to notification attempts will result in disqualification and an alternate may be selected at the Sponsor(s’) discretion. In the event the winner declines the prize or fails to return completed releases, Sponsor(s’) may elect, at their own discretion, to select an alternate winner. By entering, participants agree to release the Sweepstakes Entities from any and all liability claims or actions of any kind whatsoever for injuries, damages or losses to persons and property which may be sustained in connection with the receipt, ownership or use of the prize, or while preparing for, participating in, and/or traveling to any prize-related activity. The Sweepstakes Entities expressly disclaim any responsibility or liability for injury or loss to any person or property relating to the delivery and/or subsequent use of the prize awarded. In the event more winner notifications are issued, or more winning prize claims are received, than the number of prizes set forth in these Official Rules due to computer, printing, seeding, human, or other error or problem, a random drawing will take place from all eligible prize claims for the prize(s) at issue to award the proper number of prizes as set forth in these Official Rules. Sweepstakes Entities shall include the Sponsor, Canongate Golf Clubs, and each of their parent and affiliate companies.
In the event of sabotage, acts of God, computer virus or other events or causes beyond the Sponsor’s reasonable control which corrupt the integrity, administration, security or proper operation of the Sweepstakes, Sponsor reserves the right to cancel or suspend the Sweepstakes. In the event of cancellation, prizes will be awarded from among all eligible, non-suspect entries received prior to the event requiring such cancellation. Notice of cancellation will be sent via email to all Sweepstakes entrants.
9. Construction. The invalidity or unenforceability of any provision of these rules shall not affect the validity or enforceability of any other provision. In the event that any such provision is determined to be invalid or otherwise unenforceable, these rules shall be construed in accordance with their terms as if the invalid or unenforceable provision was not contained therein.
10. Sponsor. The Sweepstakes is sponsored by Sequoia Golf Holdings, LLC d.b.a Canongate Golf Clubs. The decisions of Sponsor and Sweepstakes judges regarding the selection of winners and all other aspects of the Sweepstakes shall be final and binding in all respects. Sponsor will not be responsible for typographical, printing or other inadvertent errors in these Official Rules or in other materials relating to the Sweepstakes.
